Healthcare Law and Ethics

Healthcare Law and Ethics

This is just a discussion post. At least one reference and in text citations in each paragraph. The more references the better. Please complete the following steps for your discussion post and response.
Read the case study below and take note of the facts.
Steven Hall is a certified nursing assistant working in a long-term care facility. The charge nurse asked Steven to stay with 15 residents who are in the recreation room watching a musical on the television.

Minerva Reese is an 85-year-old resident who is alert, oriented, and ambulates with a rolling walker. She decides that she wants to go back to her room because she does not want to watch the musical. She tells Steven she is going back to her room.

Steven believes he cannot leave the remaining 14 residents alone in the recreation room, particularly because two of the residents have advanced dementia and are unable to ambulate. He also knows that the charge nurse is very busy because another resident encountered a fall after lunch, and the ambulance is preparing to transfer that resident to the hospital for evaluation of a head injury.
Steven asks Mrs. Reese to wait a few minutes until he can get additional assistance. Mrs. Reese replies, “No, thank you. I’m going to my room.” Mrs. Reese gets up to exit the recreation room. Steven feels that he has no choice but to let Mrs. Reese walk back to her room. On the way back to her room, Mrs. Reese stumbles and falls, breaking her right hip. Her son hires a medical defense attorney, and they charge Steven with negligence.
Then, answer the discussion questions below.
Did Steven respond appropriately? Elaborate.
Was this a case of negligence? Does it contain the necessary claims to prove negligence?
Could Seven have done anything differently?
Does the nursing home and/or the charge nurse have any legal responsibility for Steven’s actions?
What would a reasonable and prudent person have done in this situation?
