I am interested in working in an assisted living facility. I have previously worked as a
caregiver and loved and hated the job. It is my hope to provide the best care for residents and
treat people with dignity and respect.
Initially, when I thought of possible legal issues in an assisted living facility I considered:
basic health and wellness, mobility, and falls, as well as nutrition. After reviewing the section, I
found a lot more that needed to be considered for liability. Some of which included licensure and
credentialling, pharmacy requirements, physical therapy needs, and contractors and partnerships.
Within each of these areas, there are also layers of regulations to manage as well.
Specifically, chapter 12 of our textbook outlined, The Joint Commission Standards
require that food and nutrition products are consistent with each patients care, treatment and
services and failure to meet these needs can lead to negligence.
Overall, negligence seems to be the highest liability within this profession. The Standard
of Care or description of the conduct that is expected of an individual in each situation is at the
precipice of determining liability within healthcare. To limit the liability and exposure for myself
and my employer, the Standard of Care within the workplace needs to be met including
managing Standard operating procedures of credentialing, scheduling, and documentation of care
and training.

What future career are you interested in with regards to health care? Can you think of

A future career that I am interested in with regards to health care is either a speech language pathologist or a
genetic counselor. Some possible legal issues that may arise in speech language pathology could be a
misdiagnosis of a speech disorder and even for a genetic counselor could be a misdiagnosis of genetics which
both could impact people’s lives if they take something I say to head and follow a regimen that could
potentially hurt them more than without it for a specific disorder or genetic malfunction they thought they
may have had. The steps I can take to limit liability and exposure for myself and employer would be to always
double check any findings. IF something is questionable, check it again. If not, do not give anyone information
that states otherwise.
